Gauhati : "Medical Report" "Negative", Rape - Accused Granted Bail by HC

In the recent Judgment [citation : [2021] GCtR 1199 (Gauhati)], the accused was alleged to have committed the offence of rape and he was in judicial custody but the medical report was negative. Initially, his application under S.439 of Code of Criminal Procedure, 1973 was rejected by Court of Sessions. 

However, HC allowed the bail application of this rape-accused. It was clearly held that "further continuation of detention of the accused in the interest of trial of case may not be needed."
