"Policyholder Entitled to Claim : Denial By Life Insurance Company is a Negligence in Service"
Recently, when the life insurance company had repudiated the claim in this case [citation : [2021] GCtR 1177], it was held, after referring the repudiation letter of the life insurance company, that when a life insurance company falsely rejects a claim, then it is a negligence in service by the life insurance company. Here, policyholder was held to be entitled to payment of claim with separate amount of compensation and another separate amount of cost of litigation.
The action of life insurance company to reject the claim was found incorrect in this decision.
