Meghalaya Temporary Employees' Regularisation Case Before Supreme Court

Supreme Court to hear the petition challenging Judgment Authored by CJ of Meghalaya HC

The petition challenging the Judgment [citation : [2021] GCtR 1347 (Meghalaya)] which was originally authored by Hon'ble CJ Shri Biswanath Somadder, one of the most brilliant Judge, is likely to be listed in the coming week [after 4 July 2021] before 2-Judges' Bench of Hon'ble Supreme Court.

When this matter was listed earlier before Hon'ble Supreme Court, Hon'ble Supreme Court had "permitted" to "serve a copy of petition to the standing counsel for State of Meghalaya".

In [2021] GCtR 1347 (Meghalaya), the challenge was to the finding of dismissal of writ petition filed in the year 2016 on the issue of regularisation. Initially, taking note of the date of appointments of "temporary employee petitioners" and referring to the leading Constitution Bench Judgment of Hon'ble Supreme Court and another Judgment of Hon'ble Supreme Court on the issue of regularisation of employees, the writ petition was dismissed. Hon'ble CJ of Meghalaya HC in [2021] GCtR 1347 (Meghalaya) had found that there are "cogent" "reasons" given while passing the Order under challenge and "no palpable infirmity" was found in the Order under challenge. However, some age relaxation related observation was made in the Order under challenge. Hon'ble CJ Biswanath Somadder, while giving his judgment, had also disposed of the miscellaneous application. 

It is relevant to note that Meghalaya High Court had a total strength of 1 Chief Justice and 3 Judges. Currently, there is no female Judge at Hon'ble Meghalaya High Court wherease Hon'ble Gauhati High Court has at least one female Judge.
