HC/Criminal Law Updates - Sexual Offences Alleged
In this recent case, a person was made an accused in respect of offences related to S.376 of IPC and various provisions of Protection of Children from Sexual Offences Act, 2012. It was alleged that said man had made a "girl pregnant". There was an FIR lodged against the man, who was the accused.
When the said accused man had filed an application under S.439 of Code of Criminal Procedure, 1973, his application was allowed with a "surety of like amount to the satisfaction of" concerned Magistrate. It was held that this accused man "need not be detained in custody" further.
