Don't List These Advocates' Cases Before This Particular High Court Judge : Direction Issued

There are many courts in India. There are several Hon'ble High Courts as well.

On 5 August 2021, Hon'ble Chief Justice of Gauhati High Court has directed that where "Shri Nishant Rai Surana and Smt. Hemprabha Betala are involved as counsel", those cases are not to be listed before Hon'ble J. Kalyan Rai Surana.  [Refer Hon'ble Gauhati High Court's Notification No. 69 dt 5 August 2021.]

Now, while this has been issued, one must study and do some research on what has been the outcome where those Advocates have been engaged and the matter was before this particular Hon'ble Judge. It is also to be noted that there are some Designated Senior Advocates practising in Hon'ble Gauhati High Court who use the word "Dr" before their names. The important point is whether a full time Ph.D. is permitted under Bar Council (Ethics) Rules without suspending one's licence. In fact, one can also do some fact finding of this practice where younger Advocates continue to pursue Ph.D. without suspending their licence and even claiming to be eligible for Senior Advocates' designation, filing vakalatnama and elevation as a Judge.
