"At that stage, the Judge was not supposed to hold a mini trial" : Gauhati High Court Allows Appeal Against Akhil Gogoi

The issue was much discussed.


Ultimately, and rightly so, in context of discharge application it was propounded at page 52 of State, NIA v Akhil Gogoi [2023] GCtR 351 (Gauhati) thus : - 


"At that stage, the Judge was not supposed to hold a mini trial".


It is useful to note that in this case, Shri Debojit Saikia (who currently is the AG of Assam) represented NIA and secured the righteous victory for nation. The decision is also important as it illustrates the erudition of Hon'ble J. Suman Shyam.
