Property Sale : Transaction Declared Illegal by HC
Many cases have been decided by Hon'ble High Courts.
In the case citation [2015] GCtR 2658, the issue was related to a litigation arising out of a property.
Here, the facts were that certain properties were there.
It was transferred to B. The sale transaction of that property was executed.
Then, litigation was initiated by A (Who was not even the owner of the property) against B. B were the parties who had bought the property in question.
Here, the implication of the applicable Act in respect to property was explained and the purpose of the Act was explained. The applicable Judgment of Hon'ble HC and Hon'ble SC was cited. However, one decision which was published in a privately run law journal was found inapplicable here. A has been able to secure victory finally in this litigation concerning property sale.
Ultimately, [2015] GCtR 2568 explains that a property sale can be declared illegal by taking appropriate legal proceedings in suitable situations.
