S.138, NI Act, 1881 : HC Acquits the Accused
Many cases have been decided by Hon'ble High Courts.
In case citation [2015] GCtR 2696, the person who was accused of committing the offence related to Section 138 of Negotiable Instruments Act, 1881 was acquitted.
Here few facts can be seen : -
Cheque was issued.
The cheque amount was of more than Rs. 1.33 lacs.
It was returned as insufficient funds being one reason.
Accused did not admitted the commission of the offence.
After relying on 2 judgments of Supreme Court, finally the accused was acquitted. There was no compromise between the accused and complainant.
