Sale and Law


Seller is defined in S.2 (13) of Sale of Goods Act, 1930. 

What may happen if goods have perished in contract of sale of specific goods is discussed in S. 7 of Sale of Goods Act, 1930.

That the bulk shall correspond with sample in quality is an implied condition in a contract for sale by sample as reflected in S. 17 (2) of Sale of Goods Act, 1930. Whereas S.18 says if goods are not ascertained then in certain types of contract, the property is not transferred to buyer. 

Tax implications are very clear from S. 64A of Sale of Goods Act, 1930. For auction sale, better refer S.64 of Sale of Goods Act, 1930.
