NDPS Act, 1985 : Bail Granted in 10 Recent Decisions
NDPS Act, 1985 contains 83 sections. Section 37 (1)(a) of NDPS Act, 1985 makes every offence under the Act cognizable.
Section 37 (1)(b) of the Act deals with bail and PP has to be given an opportunity. Commercial quantity can be understood from S.2 (viia) and the Central Government notification.
Even consumption of narcotic drugs or psychotropic substances is punishable under S. 27 (a) where sentence can be upto 1 year rigorous imprisonment.
Here are some recent ones, where bail / anticipatory bail applications of various accused persons had been allowed where offences alleged were those under NDPS Act, 1985.
