To say that merely because a plaint under Order 37 is filed and then defendant may be near bound to lose is far from the truth. As case citation [2018] GCtR 3105 reflects that if properly explained, a plaint filed under Order 37 can be declared to be even non maintainable and it is not in every case that the plaintiff can expect to succeed in a case filed under Order 37 of the Code.
