S.139, NI Act, 1881 : Supreme Court Spells out the Scope of Provision
An important judgment was passed by Hon'ble Supreme Court on 6 February 2019.
In context of Negotiable Instruments Act, 1881, it has been commented at page 16 of Bir Singh v Mukesh Kumar [2019] GCtR 1772 (SC) thus : -
"Even a blank cheque leaf, voluntarily signed and handed over by the accused, which is towards some payment, would attract presumption under Section 139 of the Negotiable Instruments Act, in the absence of any cogent evidence to show that the cheque was not issued in discharge of a debt."
