Who are Legal Heirs : HC Answers the Question

 

In Dharam Pal v Delhi Administration [2009] GCtR 3121 (Delhi) it has been held that the expression “legal heirs” would also include those who are the beneficiaries under the testament such as a Will.

It was noted in Dharam Pal (supra) that "while defining the expression “heirs”, Black's Law Dictionary, 6th Edition, also states, inter alia, as follows: “Heirs. ……….. Moreover, the term is frequently used in a popular sense to designate a successor to property either by will or by law. Word “heirs” is no longer limited to designated character of estate as at common law. Jay v. Dollarhide, 3 Cal.App.3d 1001, 84 Cal.Rptr. 538, 547.”
