Arbitrator's Power to Award Interest : High Court Explains the Law
According to Arbitration and Conciliation Act, 1996 a mechanism is created under S.34 of the Act to challenge the awards.
In a recent case, the issue of interest in arbitral awards was decided.
In Gorkha Security Services v GNCTD [2023] GCtR 2128 (Delhi), the issue of power of arbitrator to award interest was discussed.
In reaching the conclusion, a reference was also made to NHAI v. M. Hakeem [2021] GCtR 1627 (SC).
