Matrimonial Appeal : High Court Dismisses Appeal filed by Wife Challenging Order of Family Court
In India, litigations between wife and husband often arise.
Sec. 19 of the Family Courts Act, 1984 provides for an avenue for appeal. S.19 (3) of the said Act fixes a time of 30 days to file an appeal. Sec. 21 (1) of the Act confers powers on High Court to make rules.
In a recent appeal filed by wife [citation : Damini Manchanda v Avinash Bhambhani [2023] GCtR 2124 (Delhi)], the wife had challenged the Order of the Family Court.
After explaining the legal issues involved and the applicable propositions, High Court had upheld the Order of the Family Court.
Consequently, the appeal filed by the wife was dismissed.
