 Rape Accused Acquitted Even in Absence of Compromise Between Victim and Accused


Criminal Law - Section 376 of IPC - "Rape" - Allegations of Rape - "Presumption of innocence" - Victim and accused knew each other even before alleged rape occurred -  It was alleged by woman that accused raped her inside a flat - Victim got herself medically examined after FIR was lodged - CCTV recording was available - Medical examination revealed scratch marks on body of victim - Accused pleaded not guilty - Victim deposed regarding occurrence - Accused argued that story of prosecution is untrustworthy - Accused further argued that he has been falsely implicated - Awareness of victim was noted - Contradictions made by police officials was noted - Despite their being no compromise agreement between accused and victim, relying on Judgments of Hon'ble Supreme Court, accused was acquitted.
