*Criminal Law : Defamation Proceedings Quashed*
In *S. Khushboo v. Kanniammal [2010] GCtR 6010 (SC)*, defamation proceedings were quashed.
Allegations were that accused's interview had brought great shame on her and remarks of accused had caused mental harassment to a large section of women.
Accused argued that statements are fully protected under Article 19(1)(a) of the Constitution of India which guarantees freedom of speech and expression to all citizens. It was rightly held that "superior courts “may examine the questions of fact” when the use of the criminal law machinery could be in the nature of an abuse of authority or when it could result in injustice."
