 Unconstitutional Amendments to Constitution

SCAORA v. Union of India [2015] GCtR 5055 (SC) has dealt with an amendment to Constitution. Parliament had amended the Constitution. Argument made by party was "that the power exercised by the Parliament under Article 368, in giving effect to the impugned constitutional amendment (and by enacting the NJAC Act), will have to be tested in a manner, that will allow an organic adaptation to the changing times, and at the same time ensure, that the “basic structure” of the Constitution was not violated."
