Insurance Claims and Liability of Insurance Company
In case of Sri Venkateswara Syndicate Vs. Oriental Insurance Co. Ltd. and Ors [2009] GCtR 476 (SC), when a genuine insurance claim was not paid by insurance company, when matter went to litigation, insurance company was directed to pay not only the principal amount but also interest @ 9% from date even prior to filing of the case. It was held that insurance company cannot go on appointing Surveyors one after another so as to get a tailor made report to the satisfaction of the concerned officer of the insurance company.
