Liability of Police Officials
Delhi Police Act, 1978 - Section 140 - "Bar to Suits and Prosecution" - "Colour of Duty" - "Offence by Police Officer" - "A bare perusal of S.140 show that sub-section (1) of Section 140 provides that any action against a wrongful act by a police officer done under the "colour of duty" has to be initiated within 3 months from the date of the act complained off and if this time limit is exceeded, it would bar the suit or prosecution." Nature of act of the police officer has to be seen to to decide whether benefit of S.140 will be given or not. - Paul George v. State of NCTD [2008] GCtR 6111 (SC) [page nos. 3 and 5]
