Criminal Law : Converting Civil Cases into Criminal Cases and The Consequence

While imposing costs of Rs. 10 lacs on the complainant, in case of Mala Choudhary v. State of Telangana [2025] GCtR 1357 (SC), it was commented that "on a bare reading of the FIR, it is clear that a plain and simple dispute involving non-execution of a registered sale deed in terms of so-called oral agreement to sell has been given the cloak of a criminal case by misusing the criminal machinery."

Ultimately, the FIR was quashed and costs were imposed on the complainant.
