 Criminal Law : Documents Available Free of Cost under BNSS, 2023

According to BNSS, 2023 few provisions are there for supplying documents free of cost.

A copy of the information as recorded under sub-section (1) of S.173 shall be given forthwith, free of cost, to the informant or the victim. - S.173 (2) of BNSS, 2023

Copies of any record made under sub-section (1) or sub-section (3) of S.185 shall forthwith, but not later than forty-eight hours, be sent to the nearest Magistrate empowered to take cognizance of the offence, and the owner or occupier of the place searched shall, on application, be furnished, free of cost, with a copy of the same by the Magistrate. - S.185 (5) of BNSS, 2023

Police report, first information report recorded under section 173, statements recorded under sub-section (3) of section 180 of all persons whom the prosecution proposes to examine as its witnesses, confessions and statements, if any, recorded under section 183, any other document or relevant extract thereof forwarded to the Magistrate with the police report under sub-section (6) of section 193  are to be given by the Magistrate without delay, and in no case beyond 14 days from the date of production or appearance of the accused, furnish to the accused and the victim (if represented by an advocate) free of cost. - S.230 of BNSS, 2023

Record of reasons for pardon to be given to accused free of cost. - S.343 (3) of BNSS, 2023. 

Judgment in every trial in Criminal Court of original jurisdiction to be given to parties free of cost. - S.392 (4) of BNSS, 2023

When accused is sentenced to imprisonment, then copy of judgment to be given free of cost immediately. - S.404 (1) of BNSS, 2023.  -

When accused is sentenced to imprisonment and Judgment is appealable, a certified copy in language of accused is to be given without delay free of cost. - S.404 (2) of BNSS, 2023 

Any person who is affected by a Judgment or Order passed by a Criminal Court can also get copy of deposition, order, Judgment, or other part of record free of record, if Court finds special reasons. - Proviso to S.404 (5) of BNSS, 2023.
