In NICL v. Surji Devi [2014] GCtR 6268 (Allahabad), the legal position on the issue of liability under MV Act, 1988 where the driver does not have a DL was discussed and answered and whether it would lead to exoneration of insurance company or not. The onus and responsibility in cases under MV Act, 1988 was explained with abundant clarity.
