Murder of a Minister

Brij Bihari Prasad Murder Case [1998]. Rajan Tiwari v. CBI [2014] GCtR 6293 (Patna).

Two cars were there ; ShriPrakash Shukla's name as patient is not there. 

Two vehicles came ; not one. Surajbhan was not on the spot. Shriprakash Shukla was allegedly on the spot. Sudhir Tripathi or Anuj Singh or Anand Pandey were not there in initial FIR; 3-4 unidentified persons were there. Shukla had used pistol not AK47. MAntu Tiwari used Sten. Anuj, Sudhir's name appeared in supple chargesheet. 

It was not a daytime offence ; evening 8:15 p.m. 

Mantu Tiwari and Munna Shukla were present on the spot. Rajan Tiwari was alleged to be on the spot. 

Shashi Rai [MLA] was also made accused but he died later. It is at his house, allegedly, Sriprakash was seen. 

Later on, in Rama Devi v. State of Bihar [2024] GCtR 80555 (SC), Mantu Tiwari and Munna Shukla,  were convicted.  Rajan Tiwari and Surajbhan were acquitted. 

When Rajan Tiwari was acquitted by Patna HC, he was not on bail ; he was in jail. 

The Reason For Writing

Some of the books have given a distorted account of the murder of BrijBihari Prasad. Authors should ensure that anything which has been discarded by Courts should not be treated as true unless one does not believes in rule of law or has no faith in Constitution or Constitutional Courts. Courts are meant to arrive at truth ; confessions before police officials and their legal validity is already explained in provisions of BSA, 2023 and Indian Evidence Act, 1872 and they cannot become substitute for findings of Courts.
