PMLA, 2002 : The Legal Effect of Length of Custody

An important principle related to PMLA, 2002 emerged in Ashish Kumar v. State [2018] GCtR 6288 (Delhi). 

It was stated that "considering the fact that for offence punishable under Sections 3 and 4 of the PMLA, 2002 the minimum sentence prescribed is 3 years and the maximum sentence is 7 years imprisonment and the petitioner has been in custody in the PMLA case for nearly 18 months and for nearly 15 months in FIR No.205/2016, Court deemed it fit to grant bail to the petitioner."
