Property and Law : Can Developer be Treated as Owner ?

There are several myths on property. When a builder is given by an agreement any right by owner but there is no sale deed executed between owner and builder, can such a builder be treated as owner ?

In case of Deepak Mehta v. Desh Bandhu Garg [2019] GCtR 6357 (Delhi), it was held that owner remains owner and builder cannot be made owner merely because there is an agreement between owner and builder. Further, the buyer who buys property from builder but not from the owner cannot be allowed to occupy the said property.
