Property and Registration

An agreement to sell in respect of immovable property in the State of U.P. necessarily requires registration in view of the State Amendment in the Registration Act, 1908. There cannot be a sale by execution of power of attorney nor can there be transfer by execution of agreement of sale and a power of attorney and will. If a document is inadmissible in evidence for want of registration, none of its terms can be admitted in evidence. - Prabha Awasthi v. Nisha Richharia [2012] GCtR 6344 (Allahabad)
