Property Transactions and Power of Attorney : Legal Significance Answered by Supreme Court

In case of Ghanshyam v. Yogendra Rathi [2023] GCtR 1032 (SC)  law was reiterated  with regard to transfer of ownership of immovable property by way of sale deed only. In that case, A claimed to be owner on basis of agreement to sell and power of attorney. Para 12 clearly declared power of attorney to be of no consequence. It was also held that a will can be effective only on death. Para 14 has also clearly explained the effect of PoA.
