Submissions in Cases against SBI and Other Public Sector Banks

Submissions in Cases against SBI and Other Public Sector Banks

An important submission can be made in all such cases where there is delay at any step of litigation by SBI or any public sector banks.

It is most humbly submitted that law regarding delay in litigations and its consequent effect has been clarified in State of MP v. Ramkumar Choudhary [2024] GCtR 3099 (SC). In view of law laid down in that Judgment and in view of A.141, it is humbly submitted that the delay at any step of litigation by SBI do not deserve to be condoned and costs are to be imposed on SBI as well which is to be recovered from salary / pension of concerned employees of SBI. Reliance is placed on Assistant Director, ED v. Kamal Ahsan [2022] GCtR 1550 (SC). It is most humbly submitted that for any delay at any step of litigation by SBI, Hon'ble Court may kindly direct initiating disciplinary action against concerned employees and if no such disciplinary action has been taken by senior officer of SBI, contempt proceedings may be initiated against such senior officer of SBI for acting in gross violation of State of MP v. Ramkumar Choudhary [2024] GCtR 3099 (SC).
