Criminal Law : Effect of Breach of Contract on Criminal Proceedings
It has been held in Suraj Garg v. State [2025] GCtR 1497 (Delhi) that "mere failure to keep a promise or a breach of contract, without any dishonest intention at inception, does not constitute the offence."
It was also held that "the conclusions drawn by the investigating agency are not binding on the Court. The Magistrate may, upon independent application of mind, either accept or reject such a report."
