Effect of Weightage of Superior Courts and Consequence for Public Servants of Ignoring Them
It has become quite common for many public sector bank employees to say that they don't follow judicial precedents [they're not bound to even keep themselves updated about judicial precedents] or they are only bound by their internal circulars/rules made by their seniors. Perhaps, showing disdain for law or showing total apathy towards knowledge of law is a favourite activity that many public sector bank employees indulge in.
In a superbly reasoned finding in Netsity Systems Pvt Ltd v State GNCTD [2025] GCtR 1559 (SC), direction have been issued to two public servants to undergo training on what is the weightage to be given to Orders of Superior Courts. Also, direction has been issued to. head of another govt Organisation to conduct inquiry in the conduct of another public servant.
This decision can be cited and utilised in various cases whenever public sector bank employees ignore the judicial precedent or argue on a position of law which is contrary to judicial precedents so that timely disciplinary action can be initiated against such bank employees.
