Family Law / Matrimonial Law : Grant of Maintenance when Husband is working outside India


The case of Bindu Chaudhary v Deepak Suga [2016] GCtR 6366 (Delhi) was one where wife went for enhancement of maintenance amount. It was held that "if a person is working in Dubai, he earns in the currency of that country and spends also in that currency. So it is not open to the wife to just convert his income in Indian currency and then seek enhancement. The Court has to consider the cost of living as per the living standards in country where he is employed."

It was held that profession of wife, financial status, bank deposits of wife are relevant factors for calculating maintenance. Ultimately, grant of Rs. 5000/- per month of maintenance amount was found perfectly valid.
