IBC / Insolvency : Law Regarding Payment of Fees of Liquidator 

It was held in CA Santanu Brahma v. Indian Bank [2025] GCtR 1492 (NCLAT, Delhi) that even if the secured creditor proceeds to realise its security interest, it is bound to make payment of the Liquidator’s fee in terms of Regulations 2(ea), 2A, 21A and 37 of the Liquidation Regulations read with Sections 52 and 53 of the IBC, 2016.
