Insurance Claim and Repudiation : Supreme Court Directs Insurance Company to Pay Interest Amount, in addition to Claim amount

In an interesting finding of New India Assurance Co. Ltd v. Luxra Enterprises Pvt Ltd [2019] GCtR 2268 (SC) it was held that when insurance company does not pays a genuine insurance claim due to which a person has to go for litigation, then insurance company will have to pay interest amount, in addition to claim amount. 

In this case even though customer had taken insurance policy but when the claim arose, insurance company repudiated the claim which forced the customer to opt for litigation.
