Matrimonial Law / Maintenance : Capacity of Wife to Earn and Effect on Maintenance
It has been held in Chanchal Verma v. Anurag Verma [2022] GCtR 1440 (Delhi) that "it is not the capacity or the capability of the wife to earn at relevant time which is to be considered for deciding amount of maintenance, but the actual earnings at a given time are to be taken into account."
