Relinquishment Deed

A property is located in Delhi worth Rs. 50 lacs. It is co-owned by 5 brothers ; A, B, C, D and E. A makes a relinquishment deed in favour of B relinquishing his entire share in property. What will be the stamp duty payable on it ?

1. Rs. 100/-

2. Rs. 1000/-

3. It will be treated as a gift deed for Stamp purposes and not a relinquishment deed because Relinquishment deed is not in favour of all co-owners ; and if insufficient duty is paid then document will be impounded under S.33 of ISA, 1899 and penalty and duty both will have to be paid. 

4. Zero Stamp Duty.
