Varanasi Anushka Tiwari Case

Reference your episode on Varanasi Crime Story dt. 5 September 2025. 

Some facts relevant for this case are as follows : - 

Anushka Tiwari was given bail on 14 November 2024 by Allahabad HC. Refer Anushka Tiwari v. State of UP [2024] GCtR 9655 (Allahabad). She was denied bail earlier by Varanasi Sessions Court on 1 August 2023.  Next date in this case is 6 September 2025. Charges have been framed. 

7 prosecution witnesses have been examined. Anushka was arrested in 25 June 2023.

Court Case number is ST 328/2024 in Varanasi.

FIR is 225/2023 in PS Bhelupur, Varanasi. S.302 of IPC is alleged. FIR was lodged on 8 June 2023 (whereas informant knew about murder on 29 May 2023 ; hence a gap of more than 7 days).

Son stayed in Hotel Paradise Assi. He moved from Farukhabad on 25 May 2023 to Varanasi. On 26 May 2023, call with Srivats. Victim's mobile was on till 26 May 2023 till 6:51 pm. Then Srivats called in hotel of victim. Srivats had also called Anushka Tiwari. Then on 28 May 2023, Srivats called mother of victim. Then on 29 May 2023, disappearance FIR was lodged. Then Father of victim went to Kanpur but parents of girl did not allowed father of victim to meet Anushka. They said that victim has been killed. 

Girl was student of BHU, MA. It is alleged that mobile and pistol are thrown in tank. 

Statement of Co-accused Rahul Seth says 3 persons killed victim. Etios Vehicle UP 14 BX 1247 driven by Sadab Alam was used. Co-accused Rahul was near Shivam Complex with scooty. Some medicines were handed over to Anushka for feeding victim. Car was diverted near Mirzapur road and co-accused sat in car. Mobiles were kept in residence. Chandauli, Ali Nagar Crossing car was stopped. Victim was put near construction material and weapon used was a "pechkus". Pistol was used to fire while running. Mobile of victim was thrown in Bihar going truck. Poison was mixed in Juice. 

Recovery done : Pechkus. Car owned by someone else. Scooty UP 65EP 2295 owned by Shreyas Yadav. 

Nature of Injuries on victim : 1.lacerated wound and size 03 cm x 2 cm muscle deep present 8 cm abover it nippple at it Calvicular area. 2.lacerated wound of size 4 x 2 cm x muscle deep present below 7 cm below left deltiod.3. lacerated wound of size 2 cm x 1 cm muscle deep present 5cm below apex of left axila. 4. Abarasion of size 4 cm x 2 cm present at left elbow. 5. Abrasion at nect right side 4 cm x 3cm. Total 5 injuries.

Accused boys were arrested on 23 June 2023 (after more than 10 days of FIR). Anushka was arrested on 25 June 2023.

Another criminal case against Anushka Tiwari has been lodged in Case Crime no. 335/2024 under Gangsters Act, 1986 at PS Bhelupur, Varanasi. She has been granted bail in that case also. Refer Anushka Tiwari v. State of UP [2024] GCtR 6544 (Allahabad). 

Dead body of victim was recovered on 27 May 2023 as unclaimed. Body of victim was identified by mama Mukesh Kumar (it was by photo of dead body and clothes).

CCTV footages have been collected. According to police, 12 CCTVs have been used (but they show all accused in car with victim). 

Although, HC had directed in Anushka Tiwari v. State of UP [2023] GCtR 5477 (Allahabad) to conclude trial before 31 October 2024 but Trial Court failed to complete Trial. 

In my view, conspiracy has to be established between all 3. Accused might take defence of sudden and grave provocation at the heat of the moment. PMR should show some traces of poison and juice. Statement of juice-shop owner also needed.
