Service Law : Termination of an Employee-Probationer and the Obligations of the Employer

In case of Ku. Ujwala Vijay Sukhdeve v. Presiding Officer [2018] GCtR 6458 (Nagpur, Bombay), the action of terminating an employee was found to be unsustainable. The termination in this case was done because performance and conduct was not found to be satisfactory and employee was being   given   an   opportunity   to   improve   the   same, after which she was terminated. The termination was set aside. Reinstatement with full back wages was ordered. 

Employee had argued that termination order was stigmatic. The action of extending the period of probation by employee was raised by the employer, however, the termination order was found not sustainable.
