SCAORA v. Union of India [2015] GCtR 5055 (SC) establishes that even if Constitution is amended by majority, Supreme Court has power to declare such amendment to Constitution as unconstitutional. This establishes that often Parliament commits unconstitutional acts by introducing unconstitutional Amendments to Constitution. The same principles applies to statutory laws which are subordinate to Constitutional Amendments.
Art. 15 (4) was clearly not part of original Constitution and was added by an unelected body in the year 1951.
