Supreme Court Quashes Criminal Proceedings Alleging offence under S.420 of IPC

Supreme Court Quashes Criminal Proceedings Alleging offence under S.420 of IPC

In case of Suresh Kumar Agrawal v. Haldia Steels Ltd [2025] GCtR 1683 (SC), the criminal proceedings involving allegations related to S.420 of IPC arising out of an MOU and supply of certain items were quashed after noting that alleged fraud occurred in the year 2007-08 but criminal proceedings were initiated after more than 4 years. The facts observed were that the complainant had twisted the facts and a purely civil dispute was tried to be given colour of criminal offence.

It was remarked that "directing further investigation into such a frivolous complaint, filed after gross, undue and unexplained delay of six years, is nothing but a sheer abuse of the process of law."
