Whether insurance company can refuse to pay insurance claim citing non-receipt of premium amount ?
In case of New India Assurance Co. Ltd v. Gayatridham Phase Coop. Housing Society [2025] GCtR 1875 (Bombay), insurance company had refused to pay insurance claim on the ground that insurance policy has been cancelled due to non-receipt of insurance premium. It was held that insurance claim is payable and customer was held entitled to interest amount of more than Rs. 1 lacs in addition to principal insurance claim amount.
