In case of P. Chandrakala v. K. Narender [2017] GCtR 6607 (SC), dealing with a case of S.138 of Negotiable Instruments Act, 1881 and acquitting the accused it was held that since the accused has wasted the public time, while setting aside the order of conviction, accusedwas burdened with exemplary costs, which was quantified in the year 2017 at Rupees one lakh. If the accused fails to produce such acknowledgement, the order of conviction and sentence against the accused would revive and the Registrar (Judicial) shall take appropriate further action for the execution of such revival order.
