*Criminal Law : Accused Secures Acquittal From High Court*

Statements made under Section 161 of Code of Criminal Procedure, 1973 are statements made to the police during the course of investigation and the same cannot be used except for the purpose stated in the proviso to Section 162 (1) Code of Criminal Procedure, 1973. Under the proviso to Section 162 (1) of Code of Criminal Procedure, 1973, such statements can be used only for the purpose of contradicting a prosecution witness in the manner indicated in Section 145 of the Indian Evidence Act and for no other purpose. They cannot be used for the purpose of seeking corroboration or assurance for the testimony of the witness in the Court. 

Non-mention of the names of the accused persons by the doctor in the MLC cannot by itself be a ground to discard the prosecution case.
