"Law of limitation Undoubtedly Binds everybody, Including the Government" : High Court

 Government is also involved in court cases. 


In a recently pronounced Union of India v Tenzing Construction [2022] GCtR 373 (Gauhati) it has been explained at page no. 8 as under :

"The law of limitation undoubtedly binds everybody, including the Government. In a matter of condonation of delay when there was no gross negligence or deliberate inaction or lack of bona fides, a liberal concession has to be adopted to advance substantial justice, but the Government Department cannot take advantage of various earlier decisions at least in this age of electronic communication. The claim on account of impersonal machinery and inherited bureaucratic methodology of making several notes cannot be accepted in view of the modern technologies being used and available" [per Hon'ble J. Parthivjyoti Saikia]
