"Order of The Foreign Court Must Yield To Welfare of Child" : Supreme Court

There are many cases which are filed every year before Hon'ble Supreme Court.

Some of them are important.

It has been commented at page 38 of Nithya  Anand  Raghavan  Vs.  State  (NCT  of Delhi)  &  Anr [2017] GCtR 2505 (SC) thus :-

        "The order of the foreign Court must yield to the welfare of the child."

It was also commented at page 39 thus :- 

"Only in exceptionable situation, the custody of the minor (girl child) may be ordered to be taken away from her mother for being given to any other person including the husband (father of the child), in exercise of writ jurisdiction."
