Property : Legal Issue on Getting Back the Possession
There are several cases which have been decided by various Hon'ble Courts.
In the case citation [2019] GCtR 2590, the issue was related to a property situated in a city. In order to get back the possession of certain portions of property, legal proceedings were initiated by P and P was able to succeed in the legal proceedings. It was alleged that the opposite party had acted illegally in respect of the property and the questions were raised over the title of the opposite party.
Agreeing to the submissions made by P regarding the said portion of property, and looking at the evidence produced by both the sides, opposite party's pleas were not found acceptable.
[2019] GCtR 2590 guides us that in legal issues related to possession of property, ownership can also be argued. How the opposite party came to the property can also be raised in legal proceedings.
