 S.138, NI Act, 1881 : Accused Discharged by High Court


There have been many cases which have been decided by Hon'ble High Court.


In the case citation [2018] GCtR 2591, a person who was facing allegations of offences related to Section 138 of Negotiable Instruments Act 1881 was discharged. Here, it was alleged that the cheque amount was of more than Rs. 50,000 and the cheque were dishonoured. 


Referring around 11 Judgments of Hon'ble Supreme Court [Full text (PDF) Available free of cost at the website www.sci.gov.in] and explaining the scope of applicable sections of Negotiable Instruments Act, 1881, it was found that this accused needs to be discharged.
