Defamation and A Vital Legal Issue
An important issue was decided by Hon'ble Gauhati High Court on 28 March 2017.
It has been commented at page 12 of Ghisalal Agarwala v State of Assam [2017] GCtR 1143 (Gauhati) thus : -
"It is a settled position of law that except the Editor, Printer and Publisher of a newspaper no other person can be fastened with the criminal liability unless specific averment/allegation is made out in the complaint petition.”
