S.1 (2) of Waqf Amendment Act, 2025 says that this Act shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. No date has been appointed. Act has been published on 5 April 2025. Please note even for BNS, 2023, it was published on 25 December 2023 but it came into force, as government suggests, on 1 July 2024.
The History
Wakf Act, 1995 was amended in 2013 as well when a coalition Government was there ; Congress was the major party at Centre. S. 3 of 1995 Act was amended and S.3 (ee) was added to define "encroacher". S. 3 (r) was added which defined "waqf".
Original Wakf Act, 1995 was passed in 1995. It came into force on 1st January 1996. Wakf Act, 1995 was published on 22 November 1995 in the Gazette. Durgah Khawaja Saheb, Ajmer was exempted from the original Act by virtue of S.2 of the original 1995 Act. Shri P.V. Narasimha Rao was the Prime Minister when this law was made. During that time, there was Ministry of Welfare. Minister of Welfare at the time when original Wakf Act, 1995 was made was Shri Sitaram Kesari and he was from Bihar.
