 The Pending Lalu Yadav Case

CC/59/2022 [CBI v. Lalu Prasad Yadav] is the case before Rouse Avenue Court, Central Delhi. Case is pending. One can also refer RC No.2202022E0007 dated 18.05.2022. Chargesheet has been filed.

 A Preliminary Enquiry was registered on 23.09.2021. 

Charge sheet was filed on 07.10.2022 or may be on 10.10.2022. 

Case is next listed on 21 April 2025.

CBI has further asserted in the supplementary chargesheet that the shares of M/s AK Infosystems Pvt. Ltd were subsequently transferred to the family members of Mr. Lalu Prasad Yadav (A-1) namely Rabri Devi (A-2) and Tejashwi Prasad Yadav (A-3) for a nominal amount of Rs. 1 Lakh

Supplementary charge-sheet lastly alleged that 22 candidates out of the list so recovered from the hard disk were engaged in the Central Railways as substitutes in Group D.

56 + persons are accused. Tejashwi is also the accused.

Case is under S.11, S.12 and S.13 (1)(d) of PC Act, 1988 and under S.420, S.468 of IPC, 1860.  One of the accused here has challenged sanction for prosecution. 

Order dt. 22/10/2022 notes argument of an accused that "It is averred that the case of the CBI as alleged in the RC is that in 2009, the applicant was appointed as a 'substitute' in Group D post in Mumbai Zone of Railway allegedly in lieu of transferring his land in favour of Smt. Rabri Devi, wife of the then Minister of Railways, Shri Lalu Prasad Yadav and the documents submitted by the applicant for such appointment in Railways were allegedly forged." Accused argued that "But even the Vigilance Department of Railways did not find any irregularity or malpractice in the appointment of the applicant as a 'substitute' in the Railways." CBI argued that "It is submitted that investigation had revealed that during the relevant period, various individuals including the applicant had been appointed as 'substitutes' in Group-D posts and subsequently regularised in Central Railways, Mumbai, in exchange for which the individuals had, themselves or through their family transferred land at highly discounted rates to family members of Shri Lalu Prasad Yadav, the then Minister of Railways. It is stated that no advertisement or public notice was issued for appointment of 'substitutes' in Zonal Railways and the substitutes were appointed in undue haste. The due procedure and applicable guidelines/ instructions issued by Railways for appointments were not followed and later on, the services of various applicants including the applicant herein were regularized. It is alleged that the appointments were done in violation of applicable rules. The appointments should not have been approved as the application was not addressed to General Manager, Central Railways, Mumbai; the application was not routed through routine/ dak channel; the files did not reflect any urgency or the designation for appointment, both of which were critical for appointment of substitutes and substitutes were needed to fill up abnormal absences and vacancies; on the contrary it was post approval of engagement as substitutes that their postings were decided and there was no proper verification of the documents." 


Order notes the allegation that Sale deed No.2236 dated 06.02.2008 transferred a parcel of land situated at Patna measuring 3375 Sq ft. to Smt. Rabri Devi w/o Lalu Prasad Yadav on sale consideration of Rs.3,75,000/-, lower than the prevailing circle rate of Rs.4.21 lakhs and the said rate was much lower than the prevailing market rate, which was between 4 to 6 times of the circle rate and the mode of payment of consideration was also not mentioned.

Also alleged that a company M/s AK Infosystems Private Limited, which was subsequently taken over by the family members of Lalu Yadav. About 1,05,292 sq. ft. land situated at Patna was acquired by the family members of Lalu Yadav from the said persons through 05 sale deeds and 02 gift deeds and in most of the sale-deeds, payment to the sellers was mentioned to be paid in cash. The current value of the said land as per existing circle rate was about Rs.4,39,80,650/-.

Allegations of even during the period 2007-08, when he was the Minister of Railways, Government of India, with the intent to acquire the land parcels situated in Village Mahuabagh, Patna and Village Kunjwa, Patna. 

Title deeds of 61 immovable properties seized vide seizure memo dated 24.08.2022. 

Order dt. 27 February 2023 by Rouse Avenue Court, Delhi taking cognisance. 

Order dt. 2 Apr 2024 by Rouse Avenue Court, Delhi where  CBI has submitted that a composite final chargesheet, containing the details of all remaining investigation was presently under preparation. 

Order dt. 29 May 2024 notes that CBI has already filed two chargesheets and two supplementary charge-sheets in the present investigation since 2022. 

Final chargesheet filed on 7 June 2024 before Rouse Avenue Court, Delhi.

The concluding charge-sheet (CC No. 79/2024) dt 7 June 2024 as well as the previous two supplementary chargesheets in the initial two charge-sheets (CC No. 59/2022 and CC No. 44/2023) filed by the CBI are before Rouse Avenue Court, Delhi. Vide Order dt. 20 Aug 2024 it was noted that Additional documents and list of witnesses have been filed along with an application by the CBI in CC No. 44/2023 and CC No. 59/2022.

There is another RC No.220 E 0013/2017 registered by CBI/EO-II/ND. This case is separate and Case Number is CBI No.55/19 Before Rouse Avenue Court, Delhi. In this case, case was at charge in the year 2019. This case is next listed on 21 April 2025 and listed for charge.
